Copyright Policy and Copyright Notices
Foxtasy · operated by an individual · Mailing address (post only, not an office): 500 Westover Dr, Suite 38242, Sanford, NC 27330, USA
We respect the rights of creators and expect our users to do the same. This page explains how to tell us that something on Foxtasy infringes your copyright, how a user can answer, and what we do about repeat infringers.
What this page is for. Foxtasy creates AI-generated images and video from a user's prompts. Results are private to the user who made them; we do not run a public gallery or feed. A copyright claim will therefore usually concern an output that copies a protected character, artwork or other work, or text a user has typed. For claims about intimate imagery, minors or someone's likeness, use Complaints and Content Removal instead.
1. Where to send copyright notices
Send copyright notices, including notices in the form described by the US Digital Millennium Copyright Act (17 U.S.C. § 512), to:
Email (fastest): [email protected] Post: Foxtasy, Attn: Copyright, 500 Westover Dr, Suite 38242, Sanford, NC 27330, USA
Email is the quickest way to reach us; post takes longer to arrive and be handled.
2. How to send a notice of infringement
Send a written notice that contains all of the following (the elements of 17 U.S.C. § 512(c)(3)(A)):
- A physical or electronic signature of the copyright owner or of a person authorised to act for the owner.
- Identification of the copyrighted work you claim has been infringed (or a list, if several works are covered by one notice).
- Identification of the material that you claim infringes, and information reasonably sufficient for us to find it (for example the Foxtasy report/result ID, the link to where it was shared, or the account email if known).
- Your contact details: name, address, telephone number and email.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the right allegedly infringed.
An incomplete notice may not be acted on. Warning: anyone who knowingly makes a material misrepresentation in a notice (or counter-notice) may be liable for damages, including costs and legal fees (17 U.S.C. § 512(f)).
3. What we do with a valid notice
- We act promptly: we remove or disable access to the material.
- We tell the user who created it, send them a copy of the notice (which may include your name and contact details), and give them the chance to answer.
- We keep a record of the notice.
4. Counter-notice
If you are a user and your content was removed by mistake or misidentification, you may send a counter-notice to the address in section 1 containing (17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the US, for any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we send it to the complainant. We restore the material in not less than 10 and not more than 14 business days after we receive the counter-notice, unless the complainant tells us that they have filed a court action against you.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. An account that receives three valid copyright notices that were not successfully counter-noticed is closed. We may close an account sooner in serious cases.
6. Trademarks and other rights
This page covers copyright. If you believe that an output infringes your trademark (for example it uses a brand name or logo in a way that confuses), or another right (right of publicity, privacy), write to [email protected] or use the Complaints and Content Removal form with the category "Other". Include the same details as in section 2: the right you hold, how to find the material, your contact, and a statement of good faith.
7. Notices from outside the United States (notice-and-takedown)
We accept notices from rights holders and their representatives anywhere in the world. If you are outside the United States, you do not have to follow the US form above to the letter; a clear notice that contains the following is enough:
- who you are and the right you hold (copyright, neighbouring right, trademark, or another right), and the country whose law you rely on;
- identification of the work or right;
- an exact description or link to the material, and how to find it on Foxtasy;
- your contact details;
- a statement that you believe in good faith that the material is unlawful or unauthorised, and that your information is accurate; and
- if you act for someone else, proof or a statement of your authority.
We will review it diligently, act where we are able to do so lawfully, tell the affected user, and give them a chance to respond or appeal. Send it to [email protected] or [email protected].
8. EU and UK notices
A notice sent to the EU/UK may follow the same pattern as section 7 and, for the EU, the notice elements of Article 16 of the Digital Services Act (a sufficiently substantiated explanation of why the content is illegal; the exact URL or location; your name and email; and a statement of good faith). We tell you and the affected user our decision with reasons and how to appeal (see Complaints and Content Removal).
