1. Our content is computer-generated

Everything shown on or produced by Foxtasy (the "Service") — every image and every video — is created by artificial-intelligence models from text instructions (prompts, presets and settings) and from earlier AI-generated results. No photograph, film or recording of any real person is made, taken, uploaded, stored, or published by the Service. No performer is hired, filmed or photographed. The people shown are fictional, and any resemblance to a real person is accidental and not allowed by our rules.

2. Why 18 U.S.C. § 2257 and § 2257A do not apply to us

Section 2257 of Title 18 of the United States Code, and the rules made under it (28 C.F.R. Part 75), require producers of certain sexually explicit visual material to obtain proof of age and keep records for each performer who is an actual human being portrayed in an actual sexually explicit depiction (section 2257A extends this to simulated sexually explicit conduct; the rules also reach images that were manipulated so that they depict an actual human being). Because the Service produces no depiction of an actual human being — the characters are synthetic — there is no performer whose age must be verified and no such record exists or can be created. To the best of our knowledge and belief, the Service is therefore outside the scope of the record-keeping requirements of sections 2257 and 2257A, and we do not claim the status of a "primary producer" or "secondary producer" of material that depicts actual persons.

We make this statement in good faith and on the basis of our understanding of the law as it stands. It is not legal advice to you, and it does not mean that material you take from the Service and combine with real photographs or recordings is exempt: if you add real people to material, you are the producer and the duties are yours.

3. Safeguards that back this statement

  • No uploads of real people. The current version of the Service does not accept photos or videos of real people. If this changes, we will revise this statement and meet any record-keeping duties that follow before the feature is released.
  • No real people in prompts. Our rules forbid requests that use the likeness of a real person, including public figures, and our filters refuse prompts that name celebrities or point to real persons. We remove results that appear to depict an actual person once we are told or find out.
  • Adults only. Every character created on the Service must be, and appear to be, an adult. Content that shows or looks like a person under 18 is prohibited. Our filters refuse prompts that point to a minor; content that is reported to us or that we find is removed and reported to the authorities as the law requires. See our Terms, section 8.
  • 18+ audience. The Service is for adults who confirm that they are 18 or older, and may be restricted further in places where the law requires.
  • Reports. Anyone can report content without an account at the Complaints and Content Removal page. We act within 48 hours on reports of non-consensual intimate imagery or minors.

4. Custodian of records
